Biography

Thomas M. Johnson, Jr. is Of Counsel in the Washington, D.C. office of Gibson, Dunn & Crutcher. He practices in the firm’s Litigation Department and is a member of the Labor and Employment and Appellate and Constitutional Law Practice Groups.

Mr. Johnson has represented clients in a wide range of state and federal appellate and trial proceedings, in areas including labor and employment, ERISA, trademark infringement and false advertising, administrative law, class action defense, and constitutional law.

Mr. Johnson’s representative matters include:

Town of Greece v. Galloway (U.S. 2014): Briefed and second-chaired oral argument in U.S. Supreme Court on behalf of New York municipality in Establishment Clause case affirming constitutionality of client’s practice of starting legislative sessions with an invocation.

Wal-Mart Stores, Inc. v. Dukes (U.S. 2011): Assisted team in persuading the U.S. Supreme Court to decertify the largest employment-discrimination class action in history.

American Petroleum Institute v. SEC (D.C. Cir. / D.D.C. 2013): Briefed expedited appeal in D.C. Circuit, and summary judgment in federal district court, in case that resulted in vacatur of SEC rule, enacted under Dodd-Frank, that would have imposed disclosure regime on oil and gas industry at estimated cost approaching $14 billion.

Kirkendall v. U.S. Dep’t of the Army (Fed. Cir. 2007): Represented disabled veteran in successful appeal under the Veterans Employment Opportunities Act, and negotiated on client’s behalf one of the largest settlements ever obtained under that statute.

Dow Corning Corp. v. Jie Xiao (E.D. Mich. 2013): Deposed and successfully moved to exclude defendant’s expert witness in trade-secret dispute, which ultimately resulted in default judgment in client’s favor.

Successfully moved to dismiss several lawsuits arising out of widescale reduction-in-force at major automobile manufacturer for failure to plausibly allege a claim for intentional discrimination under the federal employment laws.

Represent and consult clients on a host of employment-related matters arising out of Title VII, the Age Discrimination in Employment Act, the Americans with Disabilities Act, the Fair Labor Standards Act, the Family and Medical Leave Act, the WARN Act, USERRA and ERISA (including Section 502 claims for denial of benefits, breach of fiduciary duty, and estoppel).

Mr. Johnson received his law degree, magna cum laude, in 2005 from Harvard Law School, where he was Deputy Editor-in-Chief of the Harvard Journal for Law and Public Policy and won the Irving Oberman Memorial Award, for his third-year paper on separation of powers. Before joining the firm, he clerked for one year for the Honorable Jerry E. Smith on the Fifth Circuit Court of Appeals in Houston, TX. Mr. Johnson received a B.A. in Government magna cum laude from Georgetown University in 2002.

Mr. Johnson is admitted to practice in the state of New York and District of Columbia.
