Paul Hastings LLP. Pierre Kirch Partner, Litigation Department Pierre Kirch is a partner in the Litigation Department of Paul Hastings and divides his time between the firm's office in Paris and Brussels. His practices focuses on the whole range of EU and French competition/antitrust law in its advisory and litigation aspects, which he has practiced now for some 25 years, as well as commercial litigation representation and general corporate advice. Recent Representations Samsung Electronics in EU and worldwide merger control procedures in $ 1.4 billion acquisition by Seagate of Samsung’s hard disc drive business in December 2011: unconditional Phase II merger control clearance by the European Commission in October 2011 as well as clearance worldwide in some 15 other jurisdictions (designated as competition / antitrust matter of the year 2011 by Global Competition Review). Lenovo in ongoing antitrust litigation brought by consumers throughout France concerning alleged “tying” of pre-installed software in hardware products UTi Worldwide, Inc. in ongoing European Commission “freight forwarders” antitrust case Société Générale in Le Levant I & II State aid cases against the European Commission, before the EU’s General Court (obtained annulment of Commission’s negative decision and won second court case on costs) Laporte Service Route in antitrust litigation before the Paris Court of Appeals (obtained 50% reduction in cartel fine, ruling of March 2012) and in ongoing defense against follow-on damages claims before French courts ClientEarth in four ongoing lawsuits brought against European Commission and other European institutions and agencies for violation of EU transparency rules, before the EU’s General Court and Court of Justice in Luxembourg Accolades and Recognitions Recognition, over the years, as a leading individual practitioner in the competition / antitrust field for France by publications such as Chambers Global, Guide to the World’s Leading Competition and Antitrust Lawyers, Legal 500 EMEA and the French review, Décideurs Stratégie Finance.
