Peter Janovsky, Partner

Peter Janovsky is a partner of ZEK and a member of the firm’s litigation and bankruptcy groups. Peter’s practice includes the representation of financial institutions and other clients in a wide range of commercial litigation and bankruptcy matters. He has also represented clients and written on issues in employment discrimination law.

Peter is a 1987 graduate of Fordham Law School, where he was associate editor of the Law Review. Prior to joining ZEK, Peter was at Kaye, Scholer, Fierman, Hays & Handler in New York. He has been at ZEK since 1990.

Peter’s publications include: The Enforceability of Automatic Stay Waivers in Bankruptcy Cases, Real Estate Finance & Investment, Vol. XIX, No. 26, July 1, 2013; Promises, Promises: Contracts, Fraud and Third Parties, Real Estate Finance & Investment, Vol XIX, No. 29, August 12, 2013; Relief Under Section 304 of the Bankruptcy Code: Clarifying the Principal Role of Comity in Transnational Insolvencies, 64 Fordham L. Rev. 2591 (with S. Krause and M. Lebowitz); Front Pay: A Necessary Alternative to Reinstatement Under the Age Discrimination in Employment Act, 53 Fordham L. Rev. 579 (1984).

Peter has successfully represented the firm’s clients in many cases including a successful motion to lift the automatic stay to release over $34 million in cash collateral for a bank in the WorldCom bankruptcy case, In re WorldCom, 2003 Bankr. LEXIS 2440 (Bankr. S.D.N.Y.) and litigating a family real estate dispute toward a favorable multi-million dollar settlement in simultaneous litigation and arbitration proceedings. Peter and his colleagues also obtained the dismissal of RICO claims against major banks in actions in the Federal District Court for the Southern District of New York, including Abra Constr. Corp. v. Merchs. Bank, 258 Fed. Appx. 379 (2007); and Eshel v. Fleet Bank et al., 96 Civ. 9705 (AGS). He recently obtained cross-border relief for a domestic bank client through attachments in New York used to obtain relief in Israel against defendants there. He also was affirmed by the New York Appellate Division, Second Department in defeating summary judgment seeking to dismiss a breach of contract damage claim for $24,000,000, plus interest. The case should be going to trial in January 2018.

Prior to becoming a lawyer, Peter was Assistant Principal for Supervision of Social Studies and Music at Grace Dodge Vocational High School in New York. He is also an accomplished guitarist, pianist and singer and has produced and performed two albums for Folkways Records, Winners and Losers: Campaign Songs from Critical Elections in American History, 1800-1976 (Volumes I and II). He has also written on tennis, film and other subjects for publications including Newsday, The Forward, Midstream, the MSN Network and Tennis Week Magazine.
