Lee Berner's practice focuses on real estate securitization and real estate financing matters, as well as acquisition, development and restructuring of all types of commercial real estate.

Lee represents both issuers and underwriters in a variety of real estate securitization transactions, including the formation of and initial public offerings by a number of real estate investment trusts, as well as equity and debt offerings by real estate investment trusts and other real estate organizations. His real estate securitization transactions involve a number of types of real estate, including retail, residential, office and hotel properties, and assisted living and other senior living facilities. In addition, Lee represents borrowers and lenders in a wide variety of acquisition, construction and permanent real estate financings. His practice also includes the counseling of clients in connection with purchases and sales of developed and undeveloped land, and he represents numerous landlords and tenants in lease negotiations.

Representation of a investment bank in connection with a series of real estate financings in excess of $600 million secured by more than 75 office properties.
Representation of publicly traded real estate investment trusts in connection with merger and acquisition transactions.
Lead outside real estate and finance counsel to a publicly-traded health care real estate investment trust.
Representation of a lending institution in connection with the establishment of a $300 million mortgage warehouse program in connection with mortgage securitizations.
