Biography

Larry Kass is a partner in the New York office of Milbank, Tweed, Hadley & McCloy and a member of the firm's Intellectual Property Group.

Primary Focus & Experience

Mr. Kass has extensive IP experience, including in patent and trade secret litigation; corporate, finance, & technology transactions; client counseling, and patent prosecution. His experience covers a variety of industries and technologies, including chemical, biopharma, energy, semiconductor & flat panel manufacturing, and software.

As a litigator, Mr. Kass has represented clients in a number of high-profile cases and trials. For example, he served as lead counsel in a chemical case before the International Trade Commission (ITC), securing a judgment of trade secret misappropriation for SI Group, Inc. against a sizable group of Chinese competitors. He recently argued and successfully defended the victory on appeal to the U.S. Court of Appeals for the Federal Circuit. Major corporations have relied on his litigation insight and experience for pre-suit investigations and other counseling particularly in the biopharma industry.

As a transactional attorney, Mr. Kass has led IP efforts in a broad range of corporate, finance, and technology transactions, including mergers, acquisitions, joint ventures, stock and/or asset purchases, leveraged buy-outs, and project finance transactions. In this capacity, he has drafted and negotiated IP provisions of M&A agreements, joint venture agreements, credit agreements, security agreements, collateral agreements, and other corporate & finance documents, as well as multi-party licenses for multibillion dollar projects. He has also led IP due diligence in corporate & finance transactions, for example investigating IP assets of targets in leveraged buyouts. He has also handled IP aspects of bankruptcies both on the creditor and debtor side, providing both transactional and litigation support.

Mr. Kass has supervised Milbank’s New York patent prosecution docket for years.

Recognition & Accomplishments

Mr. Kass has authored numerous articles appearing in the National Law Journal, the New York Law Journal, the American Intellectual Property Law Association Quarterly Journal, the BNA Patent, Trademark and Copyright Journal, Law360 and the Pace Law Review. He is a frequent lecturer and has been a leader in several intellectual property bar associations, including as chair of several committees for the Federal Circuit Bar Association.

Prior to law school, Mr. Kass was a Research Scientist and Development Engineer at Union Carbide/Universal Oil Products (UOP), developing processes for efficient refining, cleaner fuels, and lower automobile emissions. He was awarded several patents for his innovations.

Before joining Milbank, Mr. Kass served as Judicial Clerk to the Honorable Alvin A. Schall at the United States Court of Appeals for the Federal Circuit.
