Biography

Karl Delwaide is a founder of the firm's National Practice Group on Privacy and Information Protection, which he headed for many years. With extensive experience and successes in complex litigation, he is widely recognized as one of the few Québec lawyers with broad and significant knowledge of the courts and tribunals in the privacy and information protection areas. As such, Karl was commissioned by Mtre Jennifer Stoddart, Canada's former Federal Privacy Commissioner, to co-author a book on 10 years of case law entitled, Learning from a Decade of Experience: Quebec's Private Sector Privacy Act, published in August 2005 and revised in 2007. Karl represents private enterprises and public organizations in regard to all issues dealing with privacy, the protection of information and access to information. It also extends to Canada’s Anti-Spam legislation and the National Do Not Call List. Karl advises private and public organisations, and represents them in these matters before the Commission d'accès à l'information du Québec and other tribunals or courts, including the Federal Court. He also devotes a significant amount of his practice to administrative, regulatory, and disciplinary law, including successfully arguing judicial revisions and injunctions before the courts. For example, Karl is one of the very few lawyers familiar with the regulatory schemes applicable to the marketing of agricultural products as well as to the protection of agricultural lands. His representations in this area range from acting for the agricultural trade (buyers/processors) to advising mining, pipeline, and other companies in provincial agricultural zoning matters. Karl also advises film and television producers and broadcasters in cases of libel, slander, defamation and other issues that could potentially affect the privacy and reputation of an image.
