Biography

Joshua N. Holian is a partner in the San Francisco office of Latham & Watkins and a member of the firm's Litigation & Trial Department. He concentrates on federal and state antitrust and trade regulation issues. Mr. Holian represents clients across a range of industries in M&A transactions to secure the required antitrust clearances from US, European and other antitrust regulatory authorities. He also counsels clients on distribution, resale and pricing issues.

In addition, Mr. Holian advises clients being investigated by the US Department of Justice, the Federal Trade Commission and other antitrust regulators in matters involving allegations of price fixing, monopolistic practices, interlocking directorates and other restraints of trade. Mr. Holian also represents clients in civil litigation and arbitration disputes alleging violations of state and federal antitrust laws, including claims of price fixing, market allocation, monopolization, price discrimination, below cost sales and unfair competition.

Mr. Holian has contributed to a number of antitrust publications, including the ABA’s Antitrust Law Developments (Sixth), the California State Bar’s California State Antitrust and Unfair Competition Law, and the ABA’s Premerger Coordination Handbook. Mr. Holian also has presented at a number of antitrust programs and conferences, including presentations for the ALI-ABA, Practicing Law Institute and Law Seminars International.

Orbitz Worldwide on second request proceedings in connection with obtaining global merger clearance for its $1.3 billion sale to Expedia, Inc.
Live Nation, Inc. in its US$2.5 billion merger with Ticketmaster Entertainment
Energy Transfer Partners in its US$5.7 billion acquisition of Southern Union
Electronic Arts in its US$1.3 billion acquisition of Pop Cap Games
Oracle Corporation in defending against a DOJ lawsuit to enjoin Oracle’s acquisition of PeopleSoft
A major bank in civil antitrust litigation involving interchange fees in the Star ATM network

Stanford began offering a curriculum in legal studies in 1893, when the university engaged its first two law professors. One was Benjamin Harrison, former President of the United States, who delivered a landmark series of lectures on the Constitution. The other was Nathan Abbott, who served as head of the nascent law program. Abbott assembled a small faculty to which he imparted a standard of rigor and excellence that endures to this day.In an effort to acknowledge the emerging professional nature of the department, Stanford's Board of Trustees passed a resolution in 1908 to substitute the term 'law school' for 'law department,' though technically the law program remained a department within the university.The law school was at the forefront of efforts to institute the California Bar exam, which was added to the requirements to practice law in California in 1919. The law school was accredited by the American Bar Association in 1923, the year the ABA began certifying law schools.
