Biography

Jeffrey Elikan is a seasoned patent litigator with experience handling the full spectrum of his clients’ intellectual property needs. His successful representations include positive resolutions of pharmaceutical patent litigation, including on behalf of clients such as Warner Chilcott, Johnson & Johnson, Fougera, and Shire. He has substantial trial experience— averaging a trial per year for the last four years, including experience as a first chair and has won favorable judgments, preliminary injunctions, and negotiated dozens of favorable settlements throughout his career.

Mr. Elikan is sought after for the depth of his experience in handling Hatch-Waxman cases. These representations have involved more than twenty different product franchises in therapeutic areas ranging from antibiotics and oral contraceptives to gastrointestinal and psychiatric medications.

For pre-litigation and other purposes, Mr. Elikan performs patent portfolio reviews for clients and provides guidance on legislation affecting specific products, including biologics. Mr. Elikan also regularly provides advice to clients relating to patent litigation for a variety of purposes including for both litigation and transactional work.

Mr. Elikan’s experience extends to complex civil litigation, including antitrust and breach of contract; appellate work relating to patent litigation; and pro bono criminal defense work.

* Representation of defendants on charges of murder and attempted murder in the Circuit Courts of Montgomery and Prince George’s County, Maryland.
* Successful representation of asylum applicants from various countries, including Ukraine and Cote D’Ivoire.
