Colleen Mallon focuses her practice on complex commercial and business litigation and internal investigations.

Significant Matters
Ms. Mallon is currently representing special servicers in the CMBS industry involving repurchase and lender liability litigation and inter-creditor disputes. In connection with her representation of special servicers, Ms. Mallon has successfully obtained a decision of first impression, which was affirmed by the Second Circuit, involving the interpretation of a no-action clause which limits the rights of certificate holders in a securitization trust from bringing lawsuits against special servicers. See Teachers Ins. & Annuity, et al. v. CRIIMI MAE Serv. Ltd. P’ship, et al., 2011 WL 403428 (S.D.N.Y. Feb. 8, 2011) and Teachers Ins. & Annuity, et al., v. CRIIMI MAE Serv. Ltd. P’ship, et al., 681 F. Supp. 2d 501 (S.D.N.Y. 2010). She has also prevented mezzanine lenders from intervening and halting the foreclosure of Stuyvesant Town and Peter Cooper Village. See Bank of Am., et al. v. PCV ST Owner LP, et al, 10 Civ. 1178 (AJK) (S.D.N.Y). She obtained a TRO against mezzanine lenders which prevented them from acquiring or selling the equity interests in the borrowers without prior payment of the total amount due under the senior loan. See Bank of Am., et al. v. PSW NYC LLC, No. 651293/10, 2010 WL 4243437 (N.Y. Sup. Sept. 16, 2010).

Ms. Mallon formerly played a key role in Venable’s representation of Enron Creditors Recovery Corp., successfully recovering more than $250 million for the estate of Enron, and for other key clients, has handled internal investigations and litigation involving the Foreign Corrupt Practices Act, the Clean Air Act, and requirements contracts.

Activities
Ms. Mallon serves on the board for the House of Ruth Maryland, Inc. She is a member of the firm’s Diversity and Pro Bono Committees, and chairs the Partnership Selection Committee. Ms. Mallon is a 2008 graduate of the GBC Leadership Program.
