Biography

Bruce Linke
Partner

Bruce is a Partner in the Finance and Projects group in Australia. He is an experienced projects and construction lawyer specialising in project delivery strategies and contract documentation for engineering and construction projects.

He acts for sponsors, lenders and contractors across a range of industry sectors including mining and resources, power and renewable energy, ports and rail, process plants and property development.

Bruce has experience on all forms of project delivery and has prepared and negotiated construction contracts (including EPC and EPCM contracts), project management agreements, design and technical consultancy agreements, operation and maintenance agreements and concession agreements in Australia, South Africa and the Middle East.

Bruce is also a qualified civil engineer with practical industry experience. Prior to qualifying as a lawyer, he worked as an engineer and project manager on various mining, road, process plant and civil construction projects in Australia and Hong Kong.

Mining & Resources

Advising the project company on the Oakajee Port & Rail Project, Western Australia in relation to all construction aspects of the port and rail development, including project delivery strategy, strategic and contracting risk analysis, procurement and contract administration, drafting construction contracts, EPCM contract, design and technical consultancy agreements and project agreements.
Advising on the expansion of Jack Hills Iron Ore Mine in Western Australia in relation to the contracting and procurement strategy, drafting the EPCM contract and preparation of a suite of standard construction and procurement contracts.
Advising the project company on the West Pilbara Iron Ore Project, Western Australia, in relation to project delivery strategy, risk analysis and preparation of a suite of standard construction and procurement contracts.

Power and Renewable Energy

Advising on construction and operations and maintenance aspects of the following projects related to the Renewable Energy Independent Power Producer Procurement Programme led by the Department of Energy and Eskom in South Africa:
Advising the project company on the 100 MW Kalahari CSP Solar Project on all construction and operations and maintenance aspects of the development of the facility, including drafting and negotiating the Detailed Heads of Terms and full EPC and O&M Contracts.
Advising the project company on the 7 MW RustMo 1 Solar PV Project on all construction and operations and maintenance aspects of the development of the facility, including drafting and negotiating the Detailed Heads of Terms and full EPC and O&M Contracts.
Advising the lenders on the 6 MW Swartland Solar PV Project on the due diligence for the construction and operations aspects of the project and the negotiation of the Detailed Heads of Terms and full EPC and O&M Contracts.
Advising the EPC Contractor on the 100 MW Kaxu CSP Solar Project and the 50 MW Khi CSP Solar Project on drafting and negotiating the EPC Contract and the Early Works Contract.
Advising the project company on the Kakamas Hydro Project on the drafting and negotiation of the Detailed Heads of Terms during the bid phase.
Advising the lenders on the Kruisvallei Hydro Project on the due diligence for the construction and operations and maintenance aspects of the development and operation of the facility and negotiation of the Detailed Heads of Terms during the bid phase.
Advising the lenders on the Dorper Wind Farm on the due diligence for the construction and operations and maintenance aspects of the development and operation of the facility and negotiation of the Detailed Heads of Terms during the bid phase.
Advising the lenders on the Thupela Solar PV Project on the due diligence on the construction and operations and maintenance aspects of the development and operation of the facility and negotiation of the Detailed Heads of Terms during the bid phase.
Advising independent power producer on to the EPC Contract and O&M Agreement arrangements for the development of a coal-fired power plant to be built in the Emirate of Ajman (UAE).
Assisting in the preparation of the EPC Contract for the construction of the 400 MW gas-fired Tallawarra Power Station in New South Wales.
Assisting in the preparation of an Alliance Contract for the construction of the Tallawarra Eastern Gas Pipeline to feed a 400 MW gas-fired power station in New South Wales.
Assisting the project company in drafting a suite of standard form subcontract works contract, services and supply agreements for the Yallourn Power Station, Victoria.
Advising the lender on the due diligence for the wind turbine construction contract, interface agreements and O&M agreements for the Cathedral Rocks Wind Farm in South Australia.

PPPs

Advising the D&C contractor on the Victorian Desalination Plant PPP project during the project delivery phase.
Advising sponsor in relation to construction, interface and operations agreements with the participants on the Victoria's Royal Children's Hospital PPP Project during the bid phase.

Process plants and manufacturing

Advising a consortium led by Industrial Development Corporation (the private equity arm of the South African Government), on the development of a commercially viable and sustainable bio-ethanol enterprise in South Africa. The initial facility in the Cradock region of the Eastern Cape will produce 90 million litres of fuel grade ethanol as primary product and co-products which will be sold as high protein components into the animal feed market. The role includes drafting and negotiating the EPCM Contract, EPC Contracts for the Boilers and Dryer, a range of design, supply and installation contracts with a range of specialist European petrochemical equipment suppliers, including the negotiation of all export credit financing arrangements with a number of ECAs and various off-take agreements.
Advising an international supplier of military hardware on a border protection contract with the Saudi Arabian Ministry of the Interior.

Transport (rail, ports & airports)

Advising a government department on the relocation of motor vehicle import and export facilities from the Port of Melbourne to the Port of Geelong, including the project documentation for the development and operation of the associated infrastructure during the project feasibility phase.
Advising the consortium during the bid phase on the development of a heavy haul coal haulage rail system and coal terminal at Walvis Bay in Namibia (the Trans-Kalahari railway and port project). The project involves the development of a 1,200 km railway and new port facilities at Walvis Bay including construction, financing, third party access regime, all relevant approvals (including environment and local government), concession agreements and all other issues.
Assisting with the preparation of a suite of standard form construction contracts for use by the client at Brisbane Airport.
Assisting during the negotiations of the GMP construction contract for the Gold Coast Airport Terminal Development Project, Queensland.

Property development

Advising the developer of the Phoenix residential development, Melbourne, on the preparation and negotiation of the consultancy agreements and the design and construct agreement (with novation of consultancy agreements). Also advised the client on contract issues during the construction phase.
Advising the developer on the preparation and negotiation of the consultancy agreements and design and construct agreement for a number of commercial and residential projects associated with Melbourne’s Freshwater Place Development.
Advising the developer on the preparation of the design and construct agreement contract administration tools for the Sydney Wharves residential development.
Advising the master developer in relation to mixed-use development and infrastructure related aspects of the Palm Jumeirah, Waterfront and Palm Jebel Ali Mega City Developments in Dubai, including procurement and contract administration advice, drafting and negotiating construction contracts, consultancy agreements, operations and maintenance agreements and concession agreements for utilities (potable water, wastewater, gas and district cooling).
Advising the master developer on mixed-use development construction contracts and consultancy agreements for Dubai Healthcare City.
Advising the master developer on utility concessions and construction and consultancy contracts for Jumeirah Gold Estates, Dubai.
Advising the Dubai Maritime City Authority on procurement and consultancy agreements for Dubai Maritime City.
Advising the developer in relation to mixed-use development construction contracts and consultancy agreements for the Jeddah Medical Centre and Hospitality Complex, Saudi Arabia.
Advising investor in relation to due diligence and finance agreements for three hotels in Riyadh, Saudi Arabia.
Advising the master developer in relation to mixed-use mega city development construction contracts and consultancy agreements for the Festival City developments in Egypt and Dubai.
